This presentation will provide a summary of some of the legal aspects of green building. This program will discuss some common building agreements such as those between owners and contractors, buyers and sellers, and landlords and tenants in light of green building practices. It will also address some of the risks to those parties related to green building. As green building has increased, the potential for disputes in this area has also increased. Although there are not many cases yet regarding green building, unhappy parties have begun asserting claims, and it seems likely that these types of claims will continue to increase in the future. One way to reduce the potential for disputes is for parties to make their contracts clear about what the parties expect as to green issues.

Speakers

Evan L. Randall, Esq., LEED AP BD+C- Associate, Holland & Hart LLP
Mr. Randall represents a diverse group of real estate and business clients. He counsels clients on commercial real estate transactions, and, as a Leadership in Energy and Environmental Design (LEED) accredited professional, he understands the technical issues his clients face when working on green building projects.

His experience includes leases, sale contracts, deeds of trust, legal opinions, leasehold mortgages, promissory notes, construction contracts, easements, restrictive covenants, the Colorado Common Interest Ownership Act, subleases, and other documents. He also assists and counsels clients on business formation and related issues.


Erik V. Lemmon, Esq. Associate, Holland & Hart LLP
Mr. Lemmon counsels clients through the complex processes of commercial real estate development and financing, including master-planned developments, sales and acquisitions, title matters, land use, loan documentation, and leasing.
